the services offered by Linksmind.
These Terms of Use, hereinafter referred to as "Terms," regulate your use of the website
https://www.linksmind.com and its associated mobile application that has been developed and
managed by Linksmind LLP, hereinafter referred to as “Linksmind,” “We,” “Us,” and “Our,”
with its registered office situated at Mayabazar Floor 1, Opposite CMS High School, BC Road,
Burdwan, West Bengal.
Please read these terms of use carefully before using this site, downloading, installing, or using
our mobile application. By accessing, registering, or using this site, you agree to be bound by
these terms, including the disclaimers set forth below and the privacy policy. If you are not
willing to be bound by these terms of use, including the disclaimers and privacy policy, you may
not access or use this site or download our mobile application.
We reserve the right, at our discretion, to modify, add, or remove portions of these terms at any
time, and each such change shall be effective immediately upon posting. Please check these
terms periodically for changes. Your continued use of this site following the posting of changes
to these terms will mean you accept those changes.
Linksmind Terms and Conditions
1. General Statement
It is true to our knowledge and belief that Eduresearch Linksmind LLP, defined by the brand
name “Linksmind,” is a purely Internet-based platform providing services for learning various
subjects to students in school, undergraduate programs, and entrance exams for graduation
admission. These services are offered through verified and certified Tutoring Partners. The
company identifies the needs of the child and provides services with a perfect mentor match.
Additionally, Linksmind offers:
•Attendance System
•Notes Management
•Performance Management in the form of a dashboard with features like QMS
Attendance.
Definition: Verified and Certified Tutoring Partners
"Verified and Certified Tutoring Partners" refers to tutors who have completed Linksmind’s
certification process, which includes background checks, subject expertise verification, and
training.
2. Nature of Platform
Linksmind is an E-Commerce Tutor Aggregator Platform subject to the following Terms of Use
(“Terms”). These Terms govern access to or use of applications, websites, content, products, and
services (“Services”) offered by Linksmind, a business entity operating under Eduresearch
Linksmind LLP, headquartered at Mayabazar Floor 1, Opposite CMS High School, BC Road,
Burdwan, West Bengal.
3. Definitions and Roles
•Teacher/Tutor: Referred to as a Tutoring Partner, an independent professional who
utilizes Linksmind to connect with students and provide tutoring services.
•Tutoring Partners: Service providers delivering educational services to parents or
guardians (consumers) under the purview of the Consumer Protection Act.
•Platform Role: Linksmind acts solely as an e-commerce aggregator, facilitating the
connection between Tutoring Partners and students. Linksmind holds no direct responsibility for
the quality, delivery, or outcome of the services provided by the Tutoring Partners to parents or
students.
•Parent/Student: Users of the platform seeking tutoring services. Parents are responsible
for all obligations arising out of their use of the platform on behalf of their wards.
•Teacher Wallet: A digital wallet system within Linksmind used for financial transactions
between parents and tutoring partners.
•Demo Class: A trial session provided to parents/students to evaluate a tutor’s teaching
approach.
•Tuition Request: Digital requests sent by Parents to Tutoring Partners
4. Financial and Service Responsibilities
•Tutoring Partners pay a platform charge to Linksmind for utilizing its services.
•Tutoring Partners are independent contractors and not employees of Linksmind.
•All financial and service-related interactions are governed by the terms established
between the Tutoring Partners and parents, with Linksmind providing the technological
framework for these connections.
Dispute Resolution
Disputes between Tutoring Partners and parents, including payment or service-related issues,
must be resolved directly between the involved parties. Linksmind does not mediate such
disputes.
5. Independent Contractor Status
All Tutoring Partners are considered independent contractors, not employees of Linksmind. This
classification ensures:
•Linksmind’s role is limited to facilitating connections between tutors and students.
•Linksmind does not assume responsibility for the quality of tutoring services provided by
the tutors.
6. Consumer Protection Act Compliance
Tutoring Partners operate under the guidelines of the Consumer Protection Act when delivering
educational services to parents or guardians (consumers).
7. Services Overview
Linksmind offers personalized, one-to-one (1-1) tutoring services through its innovative
platform, creating a seamless connection between parents, students, and independent third-party
tutors or institutions. The platform emphasizes individual attention, ensuring a tailored learning
experience for each student. Classes may be conducted offline, depending on the tutor's location
and availability; however, online classes are strongly recommended to avoid wallet cancellation
or activation charges.
It is important to note that Linksmind serves solely as a technology platform and does not
directly provide tutoring services. All educational services are delivered by independent third-
party providers under agreement with Linksmind or its affiliates. These third-party providers
operate independently and are not employed by Linksmind or its affiliates.
YOU ACKNOWLEDGE THAT LINKSMIND DOES NOT DIRECTLY PROVIDE
TUTORING SERVICES AND DOES NOT FUNCTION AS A TUTORING PROVIDER. ALL
TUTORING SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY TUTORS OR
INSTITUTIONS WHO ARE NOT EMPLOYED BY LINKSMIND OR ANY OF ITS
AFFILIATES.
7.1 Class Scheduling and Billing:
Class Scheduling and Billing:
•Guru Coins System: Parents are required to purchase Guru Coins to manage payments for
classes. Guru Coins are not a form of digital currency but represent the teacher's wallet balance.
The conversion rate is 1 INR = 2 Guru Coins.
•Billing and Invoices:
●No invoices are provided for Guru Coin transactions since Linksmind does not bill this
part. However, if Linksmind deducts any platform charges from parents, a GST invoice
will be issued for that specific charge.
●Class rates for tutoring partners are not determined by Linksmind. These are a matter of
agreement between parents and tutoring partners.
•Payment Workflow:
●Parents must add the approved amount in Guru Coins to their wallet when sending a
tuition request to the tutoring partner. The equivalent amount in Guru Coins will be
deducted from the wallet for each class.
●Students/parents will receive an invoice for each class directly from the tutoring partner
through Linksmind, detailing the services provided.
●Parents and tutoring partners can mutually decide the value of Guru Coins. The
equivalent amount in Guru Coins will be deducted from the parents' wallet to the tutoring
partner's wallet after attendance is approved by the parents.
7.2 Wallet Management
•Depleted Balance: Classes will not be available if the teacher's wallet balance is depleted
or zero.
•Closed Wallet System: Wallet amounts can only be used for services on the Linksmind
platform. They cannot be used outside the platform, adhering to the closed wallet system
guidelines set by the RBI.
7.3 Teacher Replacement Policy:
Parents need to give the job post for replacement of Tutor and review the applicant as per
preference and need to send tuition requests accordingly.
7.4 Platform Charges:
•The amount paid by parents includes platform charges and management service fees,
such as mentor mapping charges.
•The remaining balance is credited to the teacher's wallet and is used by the tutoring
partner appointed by you to receive the amount after raising an invoice to you via Linksmind.
7.5 Billing and GST:
•GST invoices are available after payment of platform and management service charges.
7.6 Complaint and Grievance Redressal:
•For complaints or grievances, contact us via phone 7316980593 at 10 AM to 6 PM.

7.7 Demo Class and Introduction Video Policy
7.7.1 Subscription Demo Class
•One demo class is provided as part of the subscription. This demo class is online and lasts
30 minutes.
•The purpose of the demo class is to give parents an understanding of how classes are
conducted on the Linksmind platform, showcasing the tutor's teaching style, approach, and
interaction. If parents are guided by a Key Accounts Manager, they will be eligible for a demo
class. Otherwise, they must review the teacher's introduction video and send a tuition request.
•During the demo, parents cannot ask questions about the tutor’s location, qualifications,
or any personal details. The focus is on the tutor’s teaching methodology.
•The demo class does not guarantee the same tutor for future sessions. If parents decide to
proceed, Linksmind will try to keep the same tutor, but this is not assured.
7.7.2 Introduction Video for Tutor Replacement
•If a replacement tutor is needed (due to unavailability or a request for a different tutor),
parents can see an introduction video of the new tutor, which will be available in the profile
itself.
•The introduction video will provide a brief overview of the replacement tutor’s teaching
style, approach, and relevant details to give parents a better understanding before proceeding.
•The introduction video will not include personal details such as the tutor’s qualifications
or location, ensuring that the tutor's dignity is maintained.
•If the parents wish to replace the old tutor and hire someone else, they must send a new
tuition request to the new tutor or post a new job. Parents can review the introduction video and
hire the teacher accordingly.
7.7.3. No Additional Demo Classes for Subscriptions
•After the initial demo class, no additional demo classes will be offered under the
subscription.
•Parents can view the introduction video of tutors directly on their profile. If they wish to
replace their current tutor, they simply need to send a tuition request to a new tutor after viewing
their introduction video.
7.7.4. Respect for Tutor's Dignity:
•Both the demo class and the introduction video maintain the dignity of the tutor by
focusing on their professional teaching style and approach.
•Parents are not allowed to ask personal questions regarding the tutor’s background,
qualifications, or location, as this may undermine the tutor’s dignity.
This policy ensures that parents have a chance to preview the tutor through the demo class or the
introduction video (for replacements) while also respecting the tutor’s professionalism and
personal boundaries.
7.8 Charges and Payment Facilitation
7.8.1 Platform Charge:
•This is the fee collected by Linksmind for providing the e-commerce platform, which
includes services like access to the tutor marketplace, tutor management, payment processing,
and overall platform maintenance.
•The platform charge is typically in between 0% to 30% of the teacher wallet amount, plus
applicable GST, from the total subscription paid by the parent.
7.8.2 Teacher Wallet Amount:
•This is the amount paid directly to the tutor for their teaching services.
•After the platform charge is deducted, the remaining balance goes into the teacher wallet,
which is the tutor’s earnings for conducting the lessons.
Summary of Subscription:
•Total Subscription Amount = Platform Charge (0% to 30% + GST) + Teacher Wallet
Amount (the remaining amount paid to the tutor for the classes).
This e-commerce model ensures Linksmind can maintain and grow its platform while fairly
compensating the tutors for their services.
7.8.3 Payment Facilitation:
•By using Linksmind’s services, you acknowledge that you may incur charges for tutoring
services provided by Tutoring Partners ("Third Party Providers").
•Upon receiving these services, Linksmind will facilitate the payment of applicable
charges on behalf of the Tutoring Partners, acting as their limited payment collection agent.
Payments processed through Linksmind are considered equivalent to payments made directly to
the Tutoring Partners.
•These charges, including any applicable fees, surcharges, taxes, or other costs as required
by law, will be deducted from the Teacher Wallet of the parent. An invoice for the same will be
provided by the Tutoring Partner.
•Payments are final and non-refundable unless otherwise determined by Linksmind. If
your designated payment method is invalid or expired, Linksmind reserves the right to process
payment using an alternate method available in your account.
7.8.4 Adjustment and Cancellation:
•Charges may be subject to adjustment based on requests from the Tutoring Partners or
due to demand-based pricing.
•If you cancel a tutoring session request before the service begins, you may incur a
cancellation fee as specified by Linksmind or the Tutoring Partner.
7.9 Tuition Request & Budget Approval Process:
• Parents need to send direct tuition requests to Tutoring Partners. It is now the sole
responsibility of the Tutoring Partners to accept or decline the request.
• If the Tutoring Partner accepts the request, it will be notified to the parents through the
dashboard. If the Tutoring Partner does not accept the request, parents are encouraged to hire a
different tutor from Linksmind to avoid wallet expiry.
• If parents and Tutoring Partners need to increase or decrease their budget, it is the sole
discretion of both parties. They are requested to create a budget increment or decrement request
in the Linksmind portal of the parents. Once approved by the Tutoring Partner, the same will be
set as the new class budget and will be deducted from the parents' wallet after the teacher marks
the attendance.
8. Terms of Use Post Payment
Registration and Payment
1.All students must create a profile on www.linksmind.com.
2.After attending the demo class, students/parents must confirm the tuition and pay fees in
advance as per the selected package and billing structure.
Attendance and Learning Materials
3. Students are required to mark their attendance after each class using the prescribed process.
4. Any curriculum, notes, pedagogy, or learning materials provided digitally by the company are
strictly for self-learning purposes and must not be used for any other purpose.
5. Students must upload homework and assignments regularly through the Eduresearch
Linksmind LLP portal.
Missed Classes and Cancellations
6. If the tutoring partner attends a scheduled class but the student does not, the session will be
marked as a missed class, and no attendance will be recorded.
7. Parents recharge Guru Coins, which come with a specific validity period. If the coins are not
utilized within this timeframe, they will lapse. Should parents wish to continue utilizing the
platform, a fresh recharge of Guru Coins will be required. The unused coins will be adjusted as a
wallet cancellation charge.
8. The conduct of classes and the timing in which they are scheduled are the sole concern of the
parents and tutoring partners. If a student takes leave and the Guru Coins meet their expiry,
Linksmind will not hold any liability. Guru Coins can only be transferred to the teacher once the
teacher schedules the class, which is approved by the parents, and the teacher marks attendance,
which is also approved by the parents. Additionally, if the teacher is taking leave, parents are
advised to hire another faculty from Linksmind, either online or offline, to avoid the expiry of
the Guru Coins..
9. If a student fails to inform the tutoring partner at least 4 hours prior to the class, the tutoring
partner may claim the class coins. It will be at the sole discretion of the parents and tutoring
partner whether the class coins are transferred to the tutoring partner or not.
Payment and Subscription Management
10. Parents must make payments that include Linksmind's platform charge and recharge the
Tutoring Partner Wallet. Tutors can withdraw funds by raising invoices to parents through the
Linksmind platform. Linksmind holds no liability for the amount charged by tutors.
11Linksmind does not provide any EMI options as Linksmind is not a financial institution.
However, parents can opt for EMI through Linksmind's banking partners at the time of payment.
If the Guru Coins expire within the specified period, Linksmind will not hold any liability for
this.
12. Extra classes may be availed by recharging the Tutoring Partner Wallet, subject to the
availability of the tutoring partner.
13. Students may hire multiple teachers for each subject within an academic year as per their
specific requirements.
Tutoring Partner Selection and Replacement
14. To avoid the expiry of Guru Coins, parents can send tuition requests to as many teachers as
needed or hire as many teachers as required, but this is limited to a maximum of 25 tuition
requests and 10 job posts per month
15. Tutoring Partner appointments are subject to availability, location, calculated fees, teaching
mode (online/offline), and medical leave.
16. To avoid the expiry of the wallet or Guru Coins, if the tutoring partner misses classes, parents
should hire another tutor either online or offline..
17. Replacement teachers may conduct classes either online or offline, as it is the sole discretion
of the parents and tutoring partner.
Code of Conduct
18. Students and parents must treat teachers with respect and avoid any form of abuse,
harassment, or disrespect—either mental or physical.
19. Parents requesting female teachers must submit government ID proof for verification.
20. License
Subject to your compliance with these Terms, Linksmind grants you a limited, non-exclusive,
non-sublicensable, revocable, and non-transferable license to:
1.Access and use the Applications on your personal device solely in connection with your
use of the Services.
2.Access and use any content, information, and related materials made available through
the Services, solely for your personal, non-commercial use.
All rights not expressly granted herein are reserved by Linksmind and its licensors.
Restrictions
You may not:
1.Remove any copyright, trademark, or other proprietary notices from any portion of the
Services.
2.Reproduce, modify, prepare derivative works, distribute, license, lease, sell, resell,
transfer, publicly display, perform, transmit, stream, or exploit the Services except as expressly
permitted by Linksmind.
3.Decompile, reverse engineer, or disassemble the Services except as permitted by
applicable law.
4.Link to, mirror, or frame any portion of the Services.
5.Launch programs or scripts to scrape, index, survey, or data mine any portion of the
Services or unduly burden their operation or functionality.
6.Attempt to gain unauthorized access to or impair any aspect of the Services or related
systems.
21.Provision of the Services
The Services may be made available under Linksmind’s various initiatives or programs,
including partnerships with Tutoring Partners. You acknowledge that these Services may also be
offered in collaboration with independent third-party providers.
22.Third-Party Services and Content
The Services may include or link to third-party services or content, such as advertisements,
which are beyond Linksmind’s control. Different terms of use and privacy policies may apply to
such services or content. Linksmind does not endorse or accept responsibility for any third-party
services or content.
If you access the Services using mobile applications designed for platforms like Apple iOS,
Android, Microsoft Windows, or others, you acknowledge that the respective platform providers
are third-party beneficiaries to these Terms. However, they are not responsible for the provision
or support of the Services.
23.Ownership
The Services, along with all rights therein, remain the exclusive property of Linksmind or its
licensors. These Terms do not grant you any rights:
1.To the Services, except for the limited license outlined above.
2.To use Linksmind’s company names, logos, product or service names, trademarks, or
marks of its licensors.
24.User Accounts
To access and use most aspects of the Services, you must register for and maintain an active
personal user account ("Account"). You must be at least 18 years of age, or the legal age of
majority in your jurisdiction, to create an Account. Account registration requires you to provide
Linksmind with certain personal information, such as your name, address, contact details, and
age, as well as a valid payment method (e.g., credit card or an accepted payment partner).
You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to
do so, including having an invalid or expired payment method, may result in your inability to
access the Services or Linksmind’s termination of these Terms with you. You are responsible for
all activity under your Account and must maintain the confidentiality of your username and
password. Unless otherwise permitted in writing, you may only possess one Account.
25.User Requirements and Conduct
The Services are not available for use by individuals under the age of 18. You may not authorize
third parties to use your Account, and you may not allow minors to use the Services unless they
are under your supervision.
You must comply with all applicable laws when using the Services and may only use them for
lawful purposes (e.g., no submission of false information or unauthorized materials). You must
not cause nuisance, annoyance, or inconvenience to other users, Tutoring Partners, or any third
party.
In certain instances, you may be required to provide proof of identity to access or use the
Services. Linksmind reserves the right to deny access if you refuse to provide such proof.
26.Text Messaging
By creating an Account, you consent to receiving text (SMS) messages as part of the Service’s
operation. These messages may include notifications, updates, or promotional content. You may
opt out of receiving text messages at any time by following the instructions provided. However,
opting out may impact your ability to use certain features of the Services.
27.WhatsApp Messaging
By creating an Account, you consent to receiving messages through WhatsApp as part of the
Service’s operation. These messages may include notifications, updates, or promotional content.
You may opt out of receiving WhatsApp messages by contacting Linksmind’s support team or
following the opt-out instructions provided in the messages.
You acknowledge that opting out of receiving WhatsApp messages may impact your ability to
use certain features of the Services. Standard data rates from your mobile service provider may
apply for receiving WhatsApp messages, and you are responsible for such charges.
28.Promotional Codes
Linksmind may offer promotional codes (“Promo Codes”) that can be redeemed for credits,
features, or benefits related to the Services. Promo Codes are subject to additional terms
established by Linksmind. By using Promo Codes, you agree that:
1.Promo Codes must be used for their intended audience and purpose in a lawful manner.
2.Promo Codes cannot be duplicated, sold, or transferred without Linksmind’s consent.
3.Linksmind may disable Promo Codes at any time without liability.
4.Promo Codes are not valid for cash redemption.
5.Linksmind reserves the right to withhold or deduct credits or benefits if improper or
unauthorized use of Promo Codes is detected.
29.User-Provided Content
You may submit, upload, or provide content to Linksmind through the Services (“User
Content”). While User Content remains your property, by providing it to Linksmind, you grant a
worldwide, perpetual, royalty-free license for Linksmind to use, copy, modify, and distribute
such content in connection with its Services and business operations.
You represent and warrant that:
1.You own or have all necessary rights to the User Content.
2.Your User Content does not violate any third-party rights, including intellectual property
rights or privacy laws.
You must not provide User Content that is unlawful, defamatory, obscene, or otherwise
offensive. Linksmind reserves the right to monitor or remove User Content at its discretion,
without notice.
30.Network Access and Devices
You are responsible for securing the network access required to use the Services. Your mobile
carrier’s data and messaging rates may apply, and you are solely responsible for these charges.
It is your responsibility to acquire and maintain compatible hardware or devices necessary to
access the Services. Linksmind does not guarantee compatibility with all hardware or that the
Services will be free from delays or malfunctions due to network conditions or technical
limitations.
31.Disclaimers, Limitation of Liability, and Indemnity
Disclaimer: The services provided are offered "as is" and "as available." Linksmind disclaims all
warranties, whether express, implied, or statutory, including but not limited to implied warranties
of merchantability, fitness for a particular purpose, and non-infringement. Linksmind does not
guarantee the reliability, quality, safety, timeliness, or availability of its services or any goods or
services requested through the platform. You agree that the risks associated with using the
services, or any goods or services requested via the platform, rest solely with you, to the
maximum extent permitted by applicable law.
Limitation of Liability: Linksmind is not liable for indirect, incidental, special, exemplary,
punitive, or consequential damages, including lost profits, data loss, personal injury, or property
damage resulting from your use of the services. Linksmind is also not responsible for:
1.Issues arising from your inability to access or use the services.
2.Any relationship or transaction between you and third-party providers.
3.Delays or failures due to factors beyond Linksmind's control.
Indemnity: You agree to indemnify and hold harmless Linksmind, its officers, directors,
employees, and agents from any claims, demands, losses, liabilities, and expenses (including
legal fees) arising from:
1.Your use of the services or goods obtained through the platform.
2.Your breach of the terms.
3.Linksmind’s use of any content provided by you.
4.Your violation of third-party rights, including those of service providers.
32.Guidelines for Law Enforcement
1.Legal Requests: Linksmind requires valid legal documentation (e.g., court orders or
subpoenas) to disclose user or partner information.
2.Indian Law Compliance: Requests must comply with applicable Indian laws and
Linksmind’s privacy policy.
3.Emergency Requests: In cases of immediate threats to life or safety, law enforcement
may submit an emergency request to Linksmind.
4.(ARBITRATION)
If at any time any dispute shall arise between the parties hereto regarding the construction of
interruption of any of the terms and conditions herein contained or touching these presents or
determination of any liability of any of the parties under this Agreement, the same shall be
referred to the Joint Arbitration to be selected by the parties herein and their Joint decision shall
be deemed to be a reference within the meaning of the Indian Arbitration & Reconciliation Act,
1996 or any statutory enactment or modification there and the said Arbitrators will be nominated
by each of the Parties. In case of differences with the reference of the Joint Arbitrators to be
appointed by the respective Parties, the Joint Arbitrators will appoint a Presiding Officer and his
decision is final and binding upon the respective Parties subject to modification or a fresh
decision by the Court's of Law.
5.Amendment of Terms and Conditions: Linksmind reserves the right to modify or amend its
Terms and Conditions at any time without prior approval or notice. Any changes made will be
effective immediately upon posting on the Linksmind platform. It is the responsibility of users to
review the Terms and Conditions regularly to stay informed of any updates.

1.It is your responsibility to read all the terms and conditions before payment. If you ignore
this document before payment Linksmind does not hold any liability or damages due to that.
2.Policy on Communication and Service Guidelines
1.WhatsApp Conversations:
oLinksmind does not hold rights to any WhatsApp chats or conversations involving its
executives or any other parties.
oAny conversation between a user and an executive via WhatsApp will not be accepted as
proof of any service delivery commitment.
2.Service Guidelines and Terms & Conditions:
oThe service guidelines and terms & conditions are clearly communicated in the admission
email sent prior to payment.
oThese details are also available on the official Linksmind website and the inquiry form
that users complete during the initial inquiry.
3.Commitment of Services:
oOnly the official documents and communications provided by Linksmind through email,
the website, or other formal channels will be considered valid proof of service delivery
commitments.
33.Refund and Cancellation Policy for Parents
1.100% Money-Back Guarantee to Users: We want our parents to be satisfied with the
tutoring classes provided by our tutoring partners. If parents decide to opt-out, we offer a hassle-
free refund policy. We believe in a 10-day, 100% money-back guarantee for all Guru Coins
packages, subject to conditions. The refund will be provided only if no tuition request has been
accepted by any tutoring partner during this period.
2.Refund After 10 Days: For parents who have purchased Guru Coins worth more than
₹20,000, cancellation can still be requested by filling out a complaint form within 45 days of
subscription. Upon cancellation, Linksmind will refund the amount paid, minus:
oThe cost of all classes conducted,
o₹5000 + GST as the tuition cancellation charge,
oMentor mapping charges of ₹1180/- (including GST), which are non-refundable and non-
adjustable.
3.No Refund After 10 Days for Purchases Below ₹20,000: for purchases below ₹20,000,
any refund will not be provided after the 10-day period, regardless of whether classes were
conducted.
4.Refund Processing Time: All refunds will be processed and provided within a time frame
of 30 working days.
Note: This refund & cancellation policy is applicable to all packages that have been subscribed
through the payment gateway on the website.
